Terms of Service

1. Who we are
Arrington-Cole is operated by G & T Online Marketing LLC, doing business as Arrington-Cole ("Arrington-Cole", "we", "us", "our"). By using the site, apps, or services (the "Service"), you are contracting with G & T Online Marketing LLC.
2. What is open at launch
The current public launch lets visitors browse published looks, hear approved Arrington narration, use public social or saving controls where shown, and follow outbound shopping links. The Wardrobe, Dressing Room, Sales Floor sourcing tools, Ask Arrington, customer photo try-on, and customer wardrobe uploads are not part of the public launch.
3. Eligibility and acceptance
By using the public storefront, purchasing a subscription, or continuing to use the Service, you agree to these Terms. You must be at least 16 years old to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
4. Permitted and prohibited use
You agree not to misuse the Service. In particular you will not:
- use the Service for anything unlawful, fraudulent, deceptive, or abusive;
- send spam, harass others, or submit content that violates any third party's rights;
- infringe any intellectual property, publicity, or privacy right;
- probe, scan, or test the vulnerability of the Service, or introduce malware;
- scrape, crawl, or systematically download any part of the Service, including our AI-generated model portraits, videos, prompts, embeddings, or catalog data;
- reverse-engineer, decompile, or attempt to derive our AI models or source code;
- use the Service to train, fine-tune, or evaluate any competing AI or machine-learning system;
- resell, redistribute, or sublicense the Service or its outputs, except as expressly allowed by us in writing;
- create deepfakes, non-consensual imagery, hateful content, or content that implies endorsement by any real person.
5. Intellectual property
The Service, including all software, designs, brand assets, the "Arrington-Cole" wordmark and lockup, the Arrington character, name, voice, and likeness, the AI-generated model likenesses and their names, all narration audio, and all generated imagery, videos, embeddings, and taxonomies, are the sole property of G & T Online Marketing LLC and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable right to use the public Service for your personal styling and shopping purposes, subject to these Terms.
6. Your content
You retain ownership of text, comments, profile details, or other content you submit through a feature that is available to you ("User Content"). You grant us a worldwide, royalty-free license to host, process, and display that User Content solely to operate and improve the Service. You represent that you own or have permission to submit it and that it does not violate anyone else's rights.
Public shoppers cannot upload body photos or wardrobe photos in the current launch. Do not submit photos or audio unless we expressly open a feature that asks for them and gives you the applicable consent terms first.
7. AI-generated outputs
Model imagery, outfit recommendations, narrated commentary, and other AI outputs published by Arrington-Cole are provided for style inspiration only. Outputs may be inaccurate, may misinterpret fit or fabric, and are not professional styling, medical, legal, financial, or tax advice. Verify product details, price, availability, sizing, color, and fit with the merchant before buying.
You must not use our AI outputs to create deepfakes, to imply endorsement by any real person, or to defame, harass, or mislead anyone. Rights-holders who believe an output infringes their rights may follow the takedown procedure in our Likeness & IP Notice. Repeat infringers will be terminated.
8. Payments, subscriptions, and refunds
Arrington-Cole sells memberships and credit packs directly. Stripe processes payments on our behalf, including calculating and collecting applicable sales tax. G & T Online Marketing LLC remains the seller of record. Payment, billing, tax, cancellation, and refund mechanics are governed by these Terms and our Refund Policy.
Subscriptions auto-renew until cancelled. You can cancel at any time by emailing us at support@arrington-cole.com. Cancellation stops future billing; access continues until the end of your current billing period.
9. Service availability
We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free operation. Features may change, and we may modify or discontinue parts of the Service at any time. Parked or private tools may remain unavailable even if they are described in older screenshots, drafts, or promotional material.
10. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay fees, create security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time; paid subscriptions cancel by emailing us at support@arrington-cole.com. You may request deletion of your personal data through our Data Deletion page.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW (INCLUDING FRAUD, DEATH, OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE).
13. Indemnity
You will defend, indemnify, and hold harmless G & T Online Marketing LLC and its affiliates from any third-party claim arising out of your User Content, your unlawful use of the Service, or your breach of these Terms.
14. Governing law and venue
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws principles. The state and federal courts located in Fulton County, Georgia have exclusive jurisdiction over any dispute, and you consent to their venue.
15. Changes
We may update these Terms from time to time. Material changes take effect when posted; continued use of the Service means you accept the update.
